Can an employer change a commission structure after they sent it in writing?
My employer issued me, in writing my new commission stucture for 2007 back in December 06. Just before the year ended I landed a large order that created a very large backlog, which would result in some very large commissions. Now a month later they are telling me that because of my large backlog they will cap the amount of commission I can make. Is this legal if they already sent me the new structure in writing and there was no mention of a cap in the original?
Most of the time an employer has some sort of loop hole. We just went thru something like this with my husband’s job and our attorney said they could change their mind. My husband even signed a contract regarding his bonus. He said as long as it was the company “giving” you the bonus or commission or whatever, it was their choice.
